These Terms of Service ("Terms") govern your access to and use of the Get Aesthetic mobile app, website, and related services (the "Service") provided by GetAesthetic LLC ("GetAesthetic," "we," "us," or "our").

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Eligibility and Accounts

  • You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement and consent of a parent or legal guardian.
  • You are responsible for maintaining access to the Apple, Google, or other authentication method you use to sign in. You are responsible for activity that occurs under your account.
  • You agree to provide accurate information and to keep your account information reasonably current.

Fitness and Wellness Disclaimer

  • Get Aesthetic provides fitness, workout planning, tracking, and wellness information for general informational purposes only. The Service is not medical advice, diagnosis, or treatment.
  • You should consult a qualified medical professional before beginning or changing an exercise program, especially if you have a medical condition, injury, disability, pregnancy, or other health concern.
  • Exercise involves risk. You are responsible for using good judgment, following proper form, stopping if you feel pain, dizziness, or unusual discomfort, and seeking medical attention when appropriate.

Subscriptions, Trials, and Purchases

  • Get Aesthetic may offer auto-renewing subscriptions, free trials, promotional access, or other paid features. Subscription details, including price, billing period, trial length, and renewal terms, are shown before purchase.
  • Purchases made through the Apple App Store or Google Play are billed by the applicable app store. Your subscription automatically renews unless canceled at least 24 hours before the end of the current billing period or trial, unless the app store states a different cancellation window.
  • You can manage or cancel subscriptions through your App Store or Google Play account settings. Deleting your Get Aesthetic account or uninstalling the app does not cancel an active subscription.
  • Refunds are handled by the applicable app store unless we are legally required to provide a different process.

License and App Store Terms

  • Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial fitness and wellness use.
  • If you download the app from the Apple App Store, Apple's Standard End User License Agreement applies unless Apple or we provide a separate applicable license. The Apple Standard EULA is available at https://www.apple.com/legal/macapps/stdeula/.
  • You may not copy, modify, reverse engineer, resell, sublicense, or misuse the Service except as allowed by law.

User Content and Programs

  • You may create, save, upload, or share workouts, programs, feedback, profile information, or similar content through the Service. You retain ownership of your content.
  • You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, display, reproduce, and use your content as needed to operate, improve, support, and protect the Service.
  • If you choose to make content public or share it with others, you are responsible for that content and for ensuring you have the rights needed to share it.

Acceptable Use

  • You may not use the Service to break the law, infringe others' rights, upload harmful or misleading content, abuse support or review systems, scrape or copy the Service at scale, interfere with security, or attempt unauthorized access.
  • You may not use referral, promotional, review, or beta access codes in a fraudulent or abusive way.
  • We may suspend or terminate access if we believe you violated these Terms, created risk for the Service or other users, or used the Service unlawfully.

Privacy

  • Our Privacy Policy explains how we collect, use, share, and protect information. By using the Service, you acknowledge our Privacy Policy at https://getaesthetic.ai/privacy.

Third-Party Services

  • The Service may depend on third-party services such as app stores, authentication providers, payment and subscription tools, hosting, analytics, diagnostics, notifications, and infrastructure providers.
  • We are not responsible for third-party services, websites, policies, outages, or actions. Your use of third-party services may be governed by their own terms and privacy policies.

Disclaimers

  • The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and uninterrupted or error-free operation.
  • We do not guarantee any fitness, health, body composition, strength, performance, or wellness result.

Limitation of Liability

  • To the fullest extent permitted by law, GetAesthetic LLC and its owners, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, personal injury, or interruption of service arising from your use of the Service.
  • To the fullest extent permitted by law, our total liability for any claim related to the Service will not exceed the greater of the amount you paid us for the Service in the 12 months before the claim or 100 USD.

Termination

  • You may stop using the Service at any time. You may request account deletion through the app or account deletion page.
  • We may suspend or terminate access to the Service at any time if needed to protect users, comply with law, enforce these Terms, or operate the Service.
  • Sections that by their nature should survive termination will survive, including ownership, license restrictions, disclaimers, limitation of liability, and dispute provisions.

Governing Law

  • These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law rules. Your use of the Service may also be subject to other local, state, national, or international laws.

Changes to These Terms

  • We may update these Terms from time to time. When we make changes, we will update the date above and post the revised terms on this page. If changes are material, we may provide additional notice as appropriate.
  • Your continued use of the Service after updated Terms become effective means you accept the updated Terms.
